18/02/2010 PwC gives HMRC tax ruling a cautious welcomePricewaterhouseCoopers (PwC) has given a cautious welcome to a new court ruling that provides some clarity on the issue of how employees who work or are seconded abroad are treated from a tax standpoint.

A ruling handed down in the Judicial Review of how HM Revenue & Customs (HMRC) applied its guidance on UK tax residency concluded that the guidelines it laid down should be held as binding.

International mobility partner for PwC Sean Drury said that the firm welcomes "some of the findings" included in the judgement.

"There had been a lack of clarity and increasing HMRC scrutiny of taxpayers who legitimately ordered their affairs in accordance with published HMRC guidance to become non-resident in the UK," he remarked, adding that IR20 - HMRC's guidance tax residency - had been withdrawn in 2009.

However, the fact that only draft guidance is set to replace it means many issues regarding UK tax residency are still unclear.

Last month, research from PwC revealed that pay increases for executives at FTSE-listed companies were outstripped by the average rise across the UK for the first time in a decade during 2009.ADNFCR-1739-ID-19623648-ADNFCR
